Last year marked the 20th anniversary of the Foreign Corrupt Practices Act (FCPA) of 1977. The FCPA is the first and only statute prohibiting bribery and other corrupt business practices by U.S. citizens and companies conducting business overseas. This paper provides an overview of the FCPA during the two decades of its existence. More specifically, the objectives of this paper are four-fold. First, the paper provides background information about the FCPA of 1977 and subsequent amendments in 1988. Second, the paper (...) discusses the enforcement of the FCPA since its passage by examining the number of cases prosecuted under the FCPA and the respective penalties imposed. Third, the paper discusses the economic impact of the FCPA by addressing whether the FCPA places U.S. firms at a competitive disadvantage. Fourth, the paper provides public policy recommendations to expand the reach and scope of the FCPA. It covers efforts to criminalize bribery through multilateral organizations, such as the Organization for Economic Cooperation and Development (OECD), the World Trade Organization (WTO), and the Organization of American States (OAS). It also covers bilateral arrangements and efforts by non-governmental organizations such as Transparency International. (shrink)

The US neutrino community gathered at the Workshop on the Intermediate Neutrino Program at Brookhaven National Laboratory February 4-6, 2015 to explore opportunities in neutrino physics over the next five to ten years. Scientists from particle, astroparticle and nuclear physics participated in the workshop. The workshop examined promising opportunities for neutrino physics in the intermediate term, including possible new small to mid-scale experiments, US contributions to large experiments, upgrades to existing experiments, R&D plans and theory. The workshop was organized into (...) two sets of parallel working group sessions, divided by physics topics and technology. Physics working groups covered topics on Sterile Neutrinos, Neutrino Mixing, Neutrino Interactions, Neutrino Properties and Astrophysical Neutrinos. Technology sessions were organized into Theory, Short-Baseline Accelerator Neutrinos, Reactor Neutrinos, Detector R&D and Source, Cyclotron and Meson Decay at Rest sessions.This report summarizes discussion and conclusions from the workshop. One of John Dewey’s goals as a philosopher was to rescue his discipline from the epistemological deadlocks centered about the concept of essence, or as he might have put it, to disengage philosophy from its excessive concern with the fixed and the sure. In order to do this he stressed the contextual aspect of philosophical construction, and, so some claim, undercut belief in the existence of an a priori realm of essence determining activity. The purpose of this paper is to (...) point out that this is not the case. My procedure will be: to present Dewey’s understanding of the causes for the epistemological deadlocks in philosophy’s past; to present the implications of this understanding and its effect upon philosophical method; to present the metaphysical implications of the first two points. I hope to make it clear that Dewey recognized the existence of something prior to an experienced context which limited its possibilities and that there is validity to an inquiry into this something prior to an experienced context. The process of Slovak political tradition formation during the establishment of an independent state is discussed in the article. Special attention is paid to the authoritarian tendencies, which developed after the breakup of Czechoslovakia, atypical for Central and Eastern Europe character of political transformation and the establishment of the entire state power system are analyzed. A brief historical background of the evolution of ‘the Slovak question‘ and its influence on the development of the state is given. Authors highlight features of (...) the social structure of Slovakia, emphasizing the special mentality, greatly influenced on the formation of the political system of the state in historical perspective. It is also noted, that formation of political tradition in Slovakia at the end of the twentieth century was marked by constant struggle between coalition and the opposition, which led to increased political instability in 1995-1997, which contributed to the emergence of the political tendencies, called ‘Slovak way of transformation‘. This had an impact on the integration processes in the state, which in 1994 declared its desire to join the European Union. The authors conclude that as long as the disparate political forces were unable to find a compromise and to determine priority in order to improve life of society rather than their personal ambitions, the Slovak political life was in a state of stagnation. Various attempts have been made in recent years to present Christianity in such a way that no use is made of the traditional dichotomy between the ‘natural’ and the ‘supernatural’. Braithwaite, Hare, and van Buren, for instance, appear to have no use for the dichotomy; and I think that, without too much distortion, one can say the same of Bultmann, Tillich, and Robinson. I am not, however, concerned in this paper with the work of any one thinker as such, but (...) rather with a general climate of opinion. What I want to do is to examine the grounds on which it might be argued that belief in the supernatural is discredited. The issue seems to me of special importance at the present time, since, if these grounds are inadequate, programmes of reform under the general heading ‘Christianity without the supernatural’lose much of their point; if, on the other hand, the grounds are compelling, then reform of some kind is forced upon us whatever the accompanying difficulties. Martin Heidegger's explication of Pindar's assertion that ‘to glorify was the essence of poetry’ puts it quite well. He tells us that for Pindar the word does not derive its force from what is already complete in itself. For then man would be glorifying what is already glorious, that which already has the power to impress men. At best the word then would denote an acknowledgment or a confession of being impressed. Instead, he insists, the word denotes the power of (...) making to appear, or to extol a place. 1. (shrink)

In this paper I shall examine a variety of situations in which human agents make use of force. Section I will be concerned with the use of force in medical contexts, Section Ii with the use of force in defence of property, and Section in with the use of force in resolving international disputes. I shall argue that the boundary between what is and is not morally permissible needs to be, drawn more stringently than is commonly supposed. While agreeing that (...) in some medical contexts and in some situations where defence of property is involved the use of force may be necessary and even morally required, I shall suggest that in the absence of any suitably constituted world court the use of force in attempting to resolve international disputes creates a morally different situation. The key points in Meynell's argument seem to me to be as follows: It is logically absurd to say of an action or of a state of affairs that it is good unless at least some or other of the qualities w, x, y, z, etc. are present. Similarly it is logically absurd to talk of human flourishing unless some or other specifiable features are present in a person's life. The Heimler questionnaire shows us the sorts of ways in which (...) the notion of human flourishing might be ‘unpacked’, viz, in terms of satisfaction through friendship, etc. I am in full agreement with him over and I shall simply add some further comments on the notion of ‘evaluating’; but as far as is concerned I shall voice some doubts and reservations. We argue that abduction does not work in isolation from other inference mechanisms and illustrate this through an inference scheme designed to evaluate multiple hypotheses. We use game theory to relate the abductive system to actions that produce new information. To enable evaluation of the implications of this approach we have implemented the procedures used to calculate the impact of new information in a computer model. Experiments with this model display a number of features of collective belief-revision leading to consensus-formation, (...) such as the influence of bias and prejudice. The scheme of inferential calculations invokes a Peircian concept of ‘belief’ as the propensity to choose a particular course of action. (shrink)

Originally published in 1955. The Madhyamika philosophy is, in the author's view, the philosophy which created a revolution in Buddhism and through that in the whole range of Indian philosophy. This volume is a study of the Madhyamika philosophy in all its important aspects and is divided into three parts: Historical: this traces the origin and development of the Madhyamika philosophy. The second part concentrates on a full and critical exposition of the Madhyamika philosophy, the structure of its dialectic, its (...) conception of the Absolute and its ethics and religion. The last part of the book compares the Madhyamika with some of the well-known dialectical systems of the West (Kant, Hegel and Bradley) and undertakes a short study of the different absolutisms (Madhyamika, Vijnanavada and the Vedanta). What is sexual orientation? The contemporary consensus among philosophers is that it is a disposition. Unsurprisingly, recent debates about the metaphysics of sexual orientation are almost entirely intramural. Behavioral dispositionalists argue that sexual orientation is a disposition to behave sexually. Desire dispositionalists argue that it is a disposition to desire sexually. We argue that sexual orientation is not best understood in terms of dispositions to behave or dispositions to desire before arguing that dispositions tout court fail to illuminate sexual orientation. Postmodern understandings of the god concept, based upon sociological and anthropological insights, support the ontological reality of the god concept. AII such god constructs can be understood as real but human products which come out of a situated Drama of the Holy. The reality quotient of any god concept can be seen as a function of solidarity activities within a society. Social justice concerns are, thus, the best indicators of that reality quotient while divisive, exploitative and oppressive practices in the (...) world tend to desanctify both society and nature thus justify Death of God analyses. Two interrelated solidarity activities are discussed for their efficacy in sanctification of nature and society: 1) situated Dramas of the Holy and, 2) social policies in the political economy. A variety of grand narratives are mentioned, each with differing foundational concepts, with which to institute social justice as we move into the 21st century. (shrink)

This volume is concerned with the concept of rationality and the interrelations between rationality, belief and desire in the explanation and evaluation of human action. The book is conceived and structured to represent some of the most important general differences of approach to these problems, and also to connect them with problems about the relation of individual to social behaviour which are of central interest to historians, social theorists and economists as well as to philosophers. The essays have all been (...) commissioned for this volume and have not appeared elsewhere. The idea for the book arose from the meetings of philosophers and social scientists sponsored by the Thyssen Foundation, and is therefore a continuation of the informal series begun by C. This paper develops an explicit, pragmatic solution to the problem of deciding when an explanans which only approximately "covers" a desired event-explanandum E is acceptable as an adequate explanation. It shows in detail how comparisons made by the explanation's audience with the numerical value in E are what determine how closely E must be approximated for success. With the aid of several physics examples, it spells out the principles that govern these explanandum-comparisons, the conditions under which those principles hold, and (...) the audience traits that influence which comparisons they take seriously. There seem to exist special conditions unique to those scientific explanations which exmploy micro-parts under which alone such explanations are considered intellectually adequate. Two attempts to specify these conditions have been endorsed since antiquity, but serious counter-examples exist for each one. This paper contends that only in certain circumstances may each of the traditional criteria of adequacy be regarded as acceptable, identifies these circumstances, and examines the consequences of adopting such a dualistic or contextual solution to the problem of micro-explanation.

This paper is divided into two sections. The first aims at showing in a general way that the programme and methods of Berkeley and Professor Ryle are to a large extent similar. The second deals with one problem only. It is an attempt to provide interpretation and commentary on Berkeley's attack on “absolute existence” and on Ryle's attack on the view that there can be different “kinds of existence,” “kinds of status,” or a number of different “worlds.”.
